Terms of Service
Welcome to Smoosh. These Terms of Service (“Terms”) govern your use of the Smoosh mobile application (“the app”). By downloading, installing, or using Smoosh, you agree to these Terms. If you do not agree, do not use the app.
Smoosh is operated as an individual developer based in the United States. Contact: hello@smooshapp.com.
1. About Smoosh
Smoosh is a meal-planning inspiration app for parents of toddlers ages 1–5. The app suggests meal ideas based on the preferences you provide (your child’s age, pickiness level, safe foods, dislikes, allergies, and meal selections) and generates weekly plans drawn from a curated recipe library.
2. Important Disclaimer — Please Read
The meal ideas provided by this app are for general inspiration and informational purposes only. They are not a substitute for professional dietary or medical advice. Always consider your child’s individual nutritional needs, allergies, and any guidance from your pediatrician or healthcare provider before introducing new foods. Choking hazards vary by age — always supervise mealtimes and ensure food is prepared to an appropriate size and texture for your child.

3. Your Responsibilities
You agree to:
- Verify allergens independently. Although the app filters recipes by the allergies you specify, you remain solely responsible for reading every ingredient list, checking labels on store-bought items, and confirming that any meal is safe for your child before serving it.
- Supervise mealtimes. Choking is a real risk for young children. Always supervise your child while they eat, ensure foods are cut to age-appropriate sizes (per AAP and Solid Starts guidance), and follow your pediatrician’s advice on food introduction.
- Consult professionals. Smoosh does not replace consultation with your pediatrician, registered dietitian, or other qualified healthcare provider. Use the app’s meal ideas as inspiration alongside, not instead of, professional guidance.
- Use age-appropriate judgment. The app’s portion sizes and modifications are starting suggestions based on AAP guidelines. Your child’s actual nutritional needs may differ. Adjust accordingly.
4. No Guarantees
Smoosh provides meal ideas; it does not provide guaranteed nutritional plans. Specifically:
- We do not guarantee that any meal plan meets specific daily nutritional requirements (calories, macros, vitamins, etc.) for your child.
- We do not guarantee that recipes accommodate every possible allergy, intolerance, dietary restriction, or sensory preference.
- We do not guarantee that ingredient substitutions you make will preserve allergen safety or nutritional value.
- We do not guarantee that the app will be available 24/7 or free of bugs.
Recipes are reviewed against safety constraints including AAP guidelines and choking-prevention rules, but the app is not a medical device and has not been reviewed by the FDA.
5. Subscriptions
5.1 Free Trial
New users receive a 14-day free trial with full access to the app. The trial begins when you first launch the app.
5.2 Subscription Plans
After the trial, continued access requires a paid subscription:
- Monthly: $4.99 per month
- Annual: $39.99 per year (saves approximately 33% vs. monthly)
Prices are in US Dollars. Prices in other currencies are determined by Apple or Google and may vary.
5.3 Auto-Renewal
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your payment method (managed by Apple or Google) will be charged for renewal.
5.4 Cancellation
You may cancel your subscription at any time:
- iOS: Settings → [Your Name] → Subscriptions → Smoosh → Cancel
Android instructions will be added when available.
Cancellation takes effect at the end of the current billing period. You will retain access until that date. Smoosh cannot cancel subscriptions on your behalf.
5.5 Refunds
Refunds are handled exclusively by Apple according to their refund policy. Smoosh does not process refunds directly. To request a refund:
5.6 Price Changes
We may change subscription pricing in the future. Price changes for existing subscribers will be communicated in advance per Apple’s and Google’s policies, and you will have the opportunity to cancel before the new price takes effect.
6. Acceptable Use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract the source code of the app
- Use the app for any unlawful purpose
- Misrepresent your relationship to a child when entering profile information (the app is intended for parents and guardians)
- Attempt to bypass the subscription paywall
- Resell, redistribute, or sublicense access to the app
7. Intellectual Property
All content within Smoosh — including recipes, photos, the app’s design, the “Smoosh” name and logo, and the “Mealtime. Handled.” tagline — is owned by the developer or properly licensed. You receive a personal, non-transferable, non-exclusive license to use the app for your own household’s use.
You may share individual recipes with friends and family for personal use (the in-app share feature is designed for this). You may not republish the recipe library in bulk, scrape the app, or use the content for commercial purposes.
8. Limitation of Liability
To the maximum extent permitted by law:
- Smoosh is provided “as is” and “as available” without warranties of any kind, express or implied.
- We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.
- The developer’s total liability to you for any claim arising from or related to the app shall not exceed the amount you paid for your most recent 12 months of subscription.
- We are not liable for any indirect, incidental, special, consequential, or punitive damages.
- We are not liable for any decisions you make based on meal ideas in the app, including but not limited to allergic reactions, choking incidents, nutritional outcomes, or any other health-related event. You assume all responsibility for the meals you prepare and serve.
Some jurisdictions do not allow limitations on implied warranties or exclusions of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
9. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless the developer from any claims, damages, or expenses (including reasonable attorneys' fees) arising from: your misuse of the app, your violation of these Terms, or your violation of any law or third-party rights.
10. Termination
You may stop using the app at any time by uninstalling it and cancelling your subscription. We may suspend or terminate your access if you violate these Terms.
Provisions that by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and governing law) will survive.
11. Governing Law
These Terms are governed by the laws of the State of Alabama, United States, without regard to conflict-of-law principles. Any disputes will be resolved exclusively in the state or federal courts located in Alabama.
12. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via the app or by updating the Terms at smooshapp.com/terms. Continued use of the app after changes constitutes acceptance.
